1. Description of Services
We provide inspection services for pool and spa safety barriers in Victoria in accordance with Part 9A of the Building Regulations 2018. Services include:
Assessing your safety barrier for compliance with the applicable standard
Issuing a Certificate of Pool and Spa Barrier Compliance (Form 23) if the barrier is compliant
Providing a report (written notice) that identifies any non-compliant items with a specified rectification period, or issuing a certificate of pool and spa barrier non-compliance if required under the Building Regulations
Offering consultation and advice on pool and spa safety barriers
All inspections are carried out by a VBA-registered pool safety inspector.
2. Fees and Pricing
Fees listed on the website apply to standard residential pools and spas. Pricing may differ for commercial properties.
Definition – Commercial Property
A commercial property includes, but is not limited to, short-term rentals (e.g., Airbnb), bed and breakfasts, guest houses, boarding houses, hostels, hotels, or any property used for accommodation or business purposes.
It is the customer’s responsibility to notify us at the time of booking if the property is, or is intended to be, used for commercial purposes, as this may affect the inspection process, scheduling, or pricing. Failure to provide this information may result in additional charges, delays, or cancellation of the inspection at our discretion, without entitlement to a refund.
3. Scheduling, Changes, and Cancellations
Inspections can be rescheduled or cancelled at no cost with at least 24 hours’ notice.
Changes or cancellations within 24 hours may incur a full cancellation fee.
In rare cases, we may need to reschedule due to weather or other unforeseen events. We will notify you as soon as possible and offer the next available appointment.
4. Invoicing and Payment Terms
Invoices are issued prior to the inspection. Full payment is required before the inspection can proceed.
We accept payment via bank transfer, credit card, or PayPal. A surcharge applies to card and PayPal payments to cover processing fees.
5. Required Documents
Before the inspection, you must provide:
Council pool/spa registration letter showing the pool/spa construction date and the applicable barrier standard. Inspections cannot proceed without it. Failure to provide the letter before the inspection may result in cancellation without refund.

6. Property Access and Site Requirements
To complete the inspection, you must:
Allow access to areas around any building or structure adjoining the pool/spa.
Obtain neighbour consent: Where the pool or spa was constructed before 1 May 2010 (as indicated in your pool registration letter) and the safety barrier includes a shared boundary fence, you are responsible for obtaining the adjoining property owner’s consent to allow either physical or visual access for the purpose of inspection. Prime Pool Inspectors is not responsible for securing this consent and will not be liable for any claims, disputes, or costs arising from a failure to obtain it.
Secure animals for the duration of the visit.
Inspections cannot proceed without full access. If the required access or consent is not provided, we reserve the right to cancel the inspection without refund.
7. Use of Photo and Video Material
Photos and videos will be taken during the inspection to document the condition of your pool or spa barrier and assist in preparing the report. These will be used for inspection and compliance purposes. If we wish to use any photos or videos for promotional purposes, we will contact you to obtain your prior written consent.
8. Privacy and Data Protection
We respect your privacy and do not share any personal information, photos, or videos with third parties—except where required by law or requested by local councils or regulatory authorities for pool and spa safety compliance.

9. Liability and Indemnity
Our inspector may test parts of your pool or spa barrier as required by the applicable standard. You agree that we are not liable for any damage resulting from such testing and will indemnify us against any related claims.
10. Safety
The safety of the inspector is our priority. We reserve the right to terminate an inspection at any time if the inspector is subjected to abuse, threats, or unsafe conditions. No refund will be issued in such cases.
11. Inspection Report Use and Limitations
Our inspection reports may include recommendations for addressing non-compliance items; however, these are provided for guidance only and are not exhaustive.
Reports are prepared for the named client(s) and must not be altered or misrepresented. Clients may share the original report with relevant authorities. Misuse or misrepresentation may result in legal action.
12. Reports and Certificates Delivery
Inspection reports and certificates will be emailed to the address provided at booking, as soon as practicable after the inspection. Once sent, documents are deemed delivered.
You are responsible for providing a correct email and checking your inbox, including spam/junk folders.
We are not liable for delays or non-receipt due to incorrect contact details, misdirected or filtered emails, or technical issues.
13. Follow-up Inspection
A follow-up inspection fee applies to each additional inspection due to non-compliance (maximum of two). If the follow-up inspection is not scheduled and paid within the timeframe stated in the report (written notice), a Certificate of Non-Compliance will be issued, and a copy sent to the local council.
Any inspection following the issuance of a certificate of non-compliance—whether due to failure to rectify the non-compliance, denial of site access, or any other reason as defined under the Building Regulations 2018—will be charged at the standard rate.
14. Inspection by Third-Party Contractor
If the originally assigned inspector is unavailable, a qualified, registered, and insured contractor may carry out part or all of the inspection process. You will be notified if this occurs. Certificates will be issued under the contractor’s company name and registration, and the contractor is solely responsible for their work.
15. Submitting Certificates to Council
You must submit the Certificate of Pool and Spa Barrier Compliance to your local council within 30 days of the issue date. If not submitted, the certificate expires and a new inspection (at full cost) is required.
16. Swimming Pool and Spa Barrier Maintenance Obligations
Under the Building Regulations 2018:
The landowner must ensure the pool or spa barrier is properly maintained.
The occupier must ensure the barrier operates effectively and gates/doors remain closed, except when entering or leaving the area.
Any person who opens a gate or door forming part of the barrier must close it immediately after entering or leaving the pool or spa area.
17. Acceptance of Terms
